These Membership Terms & Conditions (“Terms”) govern the Helmet28 Membership programme (“Membership”) operated by Helmet28 (“we”, “our”, “us”). By purchasing or renewing a Helmet28 Membership, you agree to be bound by these Terms alongside our Website Terms & Conditions, Privacy Policy and Returns Policy.
1. Membership Eligibility
1.1 Membership is available to individuals aged 16 years or over.
1.2 Membership is personal to the account holder and is non-transferable.
1.3 Membership may only be used by the individual who purchased it and may not be shared, resold or assigned to another person.
2. Membership Types
Helmet28 may offer one or more Membership tiers, including free and paid (Premium) Memberships.
The benefits available under each Membership tier will be displayed on our website and may be updated from time to time.
3. Premium Membership Subscription
3.1 Premium Membership is purchased as a single annual payment.
3.2 Your Premium Membership will remain active for 12 months from the date of purchase.
3.3 At the end of each Membership period, your Membership will automatically renew for a further 12-month period unless you cancel your automatic renewal before your renewal date.
3.4 Renewal payments will be taken using your original payment method unless updated by you beforehand.
4. Promotional Membership Pricing
4.1 From time to time Helmet28 may offer discounted Membership promotions, including introductory offers such as 50% off your first year.
4.2 Any promotional Membership pricing applies only to the initial Membership term unless expressly stated otherwise.
4.3 Upon renewal, your Membership will automatically renew at the standard full annual Membership price applicable at that time.
4.4 It is your responsibility to cancel your Membership before renewal if you do not wish to renew at the full annual price.
5. Cancellation & Refunds
Cancelling Auto-Renewal
5.1 You may cancel your Membership’s automatic renewal at any time through your online Helmet28 account.
5.2 Cancelling automatic renewal will prevent future renewal payments but your Membership benefits will remain active until the end of your current Membership period.
Refunds
5.3 Premium Membership payments are non-refundable except where required by applicable consumer law or where the conditions below are met.
5.4 You may request a refund within 14 days of purchasing your Premium Membership provided that:
- no orders have been placed using your Membership benefits;
- no Membership free gift has been dispatched or redeemed; and
- no Membership benefits have otherwise been used.
5.5 Where any Membership benefit has been used, including placing an order using Membership pricing or where a Membership free gift has been dispatched, your Membership becomes non-refundable.
6. Membership Benefits
Membership benefits may include, but are not limited to:
- Exclusive member pricing
- Free shipping (Premium Members only)
- Early access to selected launches
- Exclusive promotions
- Competitions
- Member-only content
- Exclusive events
- Other benefits announced throughout the Membership period
Benefits vary depending on Membership tier.
Helmet28 reserves the right to introduce, amend, suspend or withdraw any Membership benefit at any time where reasonably necessary for commercial, operational or legal reasons.
Where possible, we will provide reasonable notice of significant changes.
7. Member Discounts
7.1 Membership discounts apply only to eligible products listed on the Helmet28 website.
7.2 Membership discounts may be used in conjunction with Helmet28 Bundle Builder discounts where applicable.
7.3 Membership discounts cannot be used alongside any other promotional offer including (but not limited to):
- Sale pricing
- Promotional discount codes
- Affiliate discount codes
- Influencer discount codes
- Partner discounts
- Any other promotional pricing unless expressly stated by Helmet28
7.4 Where multiple discounts are available, Helmet28 reserves the right to apply the highest single eligible discount only.
8. Shipping
8.1 Membership discounts do not apply to shipping charges.
8.2 Premium Members receive free shipping on eligible orders in accordance with the shipping benefits advertised for their Membership.
8.3 Free shipping benefits may be subject to minimum order values or geographical restrictions where stated on our website.
9. Returns & Consumer Rights
9.1 Membership does not alter your statutory consumer rights.
9.2 All product purchases remain subject to Helmet28’s Returns Policy.
9.3 Membership status does not provide extended return periods or additional refund rights unless expressly stated.
10. Misuse of Membership
Helmet28 reserves the right to suspend or terminate Membership immediately where we reasonably believe a Member has:
- shared their Membership with another individual;
- used Membership fraudulently;
- attempted to exploit pricing errors;
- purchased products for resale using Membership benefits;
- abused Membership offers or promotions; or
- otherwise breached these Terms.
No refund will be provided where Membership is terminated due to misuse.
11. Failed Renewal Payments
If we are unable to collect your renewal payment:
- your Membership benefits may be suspended;
- we may attempt to take payment again; and
- if payment remains unsuccessful your Membership may expire automatically.
12. Changes to Membership
Helmet28 continually develops its products, services and Membership offering.
Accordingly, we reserve the right to:
- amend these Terms;
- change Membership pricing;
- modify Membership benefits;
- introduce new Membership tiers; or
- withdraw existing Membership tiers,
provided such changes comply with applicable consumer law.
Where significant changes affect your Membership, we will provide reasonable notice where practicable.
13. Suspension or Withdrawal of the Membership Programme
Helmet28 reserves the right to suspend or discontinue the Membership programme where reasonably necessary.
If the Membership programme is withdrawn entirely, affected Members will be notified in advance wherever reasonably possible.
14. Privacy
Personal information collected as part of your Membership will be processed in accordance with our Privacy Policy.
15. Limitation of Liability
Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded.
Subject to applicable law, Helmet28 shall not be liable for indirect or consequential loss arising from participation in the Membership programme.
16. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
